Ought to be the mastermind. But it all depends. What if accomplice is low IQ? Or Mastermind is manipulated into calling the shots?

you can read a textbook on this. Generally it is the same, unless the accomplice only executed part of the deed

so if 2 accomplices killed a bystander, when the plan was just to rob the pawn shop, then only the 2 accomplices are on trial for murder

however if the plan included neutralising the security guard and he is killed in the scuffle, then the mastermind may be included as well
