what the fuck did Mississippi do this time--
That (sorry for the flag)
I hate my state so goddamn much
I grew up there and I know what you mean
omg you escaped I'm happy for you
I lived there for six years and have never looked back. I wonder why
oh my god definitely getting my fiancee out of there ASAP...
like he's straight and white but even so that's just shitty
...isn't that law literally illegal by constitutional standards?
because of separation of church and state?
or does that... not apply at the state level for some reason?
it should be, and fingers crossed it does come to the supreme court
If anything the ACLU will attack the shit out of this because this is beyond unconstitutional
"Protecting Freedom of Conscience" oh my god fuck the asshole this rode in on
states aren't allowed to add restrictions that federal law does not. So for instance federal law allows people to vote at 18. A state could allow people to vote at a younger age, but couldn't deny people over 18 the right to vote by making the age limit be 20, for example.
so this wouldn't have a leg to stand on at the federal level.
As for the law, it should be illegal and it was held off for some time before the Fifth Circuit overturned the injunction against it
More info’s in the wiki link above
since federal law allows same sex marriage, state law cannot deny it
It's just a question of getting it there.
The law isn’t blocking marriage, it’s saying that anyone who wants to discriminate has implicit approval
Which again should be illegal at the state level
which goes against federal laws as well, since there are anti-discriminatioon laws that do protect sexuality
in a case like this, a state is allowed to add extra protections, but they cannot deny protections that exist on the federal level
yeah, the judge who issued the initial injunction wrote a sixty page long opinion eviscerating the law, and some other judge basically said "lol no one's been harmed yet" and struck down the injunction
I wish I could say I was surprised.
